Auto-tier rsync+ssh acl error looks like a BUG

Hello.
I have two identical nexenta boxes each running a fresh install of 3.1.2 community edition.
One box is active directory integrated with CIFS shares and acls defined. I want to back this up with auto-tier to the other nexenta box.
On the first AD integrated box I have created an auto tier service that is Pushing TO the other nexenta box which is bound in SSH bindings. The service creates correctly.
When I try to run the service I get the following error:
Apr 09 10:00:37 (zfs-auto-tier, 17743) from: localhost:/volumes/pool0, to: 192.168.128.8:/volumes/pool0, proto=rsync+ssh
Apr 09 10:00:38 Started job at localhost type: acl_collector_job, pid: 17768
Apr 09 10:02:50 (zfs-auto-tier, 17743) Error from ACL callback (before): OperationFailed: the job was not completed successfully
Can anybody tell me why this happens and what I can do about it?

A further update.
This is really starting to look like a bug to me.
It doesnt matter whether I create the auto tier pushing to the other san or pulling.
It doesnt matter whether I try to sync only a specific folder e.g. pool0/data or the whole pool e.g. pool0/
I have applied all upgrades available to both machines, and the error given above is always present GUARANTEED.
Any help?
